It has been identified that the MW125 Tricity was certified for entry into service without having a parking brake as required by Land Transport Rule: Light-vehicle Brakes 2002.
Yamaha Motor New Zealand applied for an exemption to the requirement and demonstrated to the NZ Transport Agency that the front end is like that of a motorcycle, i.e. not fixed and it will fall over when not supported.
The NZ Transport Agency agreed that the risk to safety is minimised and an exemption was issued. A requirement of the exemption is to fit a label on each scooter to inform WoF inspectors.
